Immigration and Customs Enforcement (ICE) has recently increased its investigation and enforcement efforts in regards to I-9 (Employment Eligibility Verification Form) compliance. In June 2011, ICE agents served subpoenas on 1,000 employers across the United States which required that they turn over original I-9 forms, as well as significant corporate documentation, for review.
Although it appears to be a simple, one-page form, the I-9, Employment Eligibility Verification Form, is perhaps among the most complex of responsibilities for an organization’s Human Resources personnel. To add to this challenge is the potential for serious consequences for failure to complete the form correctly or to recognize proper and permissible documents. These consequences range from warnings, to government investigations, to fines, and even criminal prosecution.
