
James Tamm and Paul Indyk recently secured the dismissal of a physician in Wayne County Circuit Court.
The matter involved claims of improper evaluation and treatment of a patient’s pressure wounds and nutritional status. A motion for summary disposition was filed which argued that the plaintiff’s claims sounded in medical malpractice and not ordinary negligence. The motion further argued that the plaintiff failed to timely file the lawsuit, even with the benefit of additional time allowed by the COVID-19 Administrative Orders, and therefore was barred by the statute of limitations. The Wayne County Circuit Court granted the motion for summary disposition and dismissed the case in its entirety.
