James E. Tamm and Paul M. Indyk were successful in obtaining a voluntary dismissal for a hospital client in a medical malpractice matter after nearly two years of litigation.
The matter involved claims of improper evaluation and treatment following the removal of an abdominal tumor. The voluntary dismissal came after a motion for summary disposition was filed which argued that the Plaintiff’s expert was not qualified to offer standard of care testimony against the hospital’s resident physician. The Wayne County Circuit Court previously granted a motion for summary disposition holding that the hospital was not vicariously liable for the actions of the attending physician.
