Creditors' Rights

Kerr Russell represents a wide range of secured and unsecured creditors in all types of commercial matters. We assist businesses, individuals, lenders, trade creditors, and financial institutions, in recovering debt or collateral, including asset seizure and recovery, judgment liens, garnishments, mortgage foreclosures, land contract forfeitures, mortgage and land recovery and sale, and claim and delivery (replevin) actions.

Our comprehensive services include all aspects of the commercial debt collection process, from document preparation, review, filing and response, to representation in court proceedings. We have substantial experience handling cases involving fraudulent conveyances, foreclosures of security interests, repossessions, preference claims, adversary proceedings, claim and delivery actions, enforcement of rights under Article 9 of the Uniform Commercial Code, and landlord/tenant actions, among others.

A particular strength of our Creditors’ Rights Practice involves handling automotive supplier disputes, automotive warranty actions, supply chain disputes, and troubled supplier matters.

Kerr Russell also advises clients on issues related to the federal Fair Debt Collection Practices Act and the Fair Credit Reporting Act, and defends lawsuits brought under these Acts.  Additionally, we counsel clients on issues related to distressed customers and customers who have filed bankruptcy.
