Kerr Russell attorneys are regarded as formidable advocates in the courtroom and around the negotiating table, and we are involved in all manner of disputes across our practice areas.

We bring significant resources to bear when our clients need us, whether that means defending them against claims or enforcing their rights. However, because we approach litigation as a final option, we are equally adept at achieving resolution without going to trial, and counseling clients on litigation-avoidance strategies in advance to avoid costly disputes in the first place.

Our wealth of experience in trial work provides us an acute sense of when it is best to try a case or to settle a dispute outside of the courtroom. We are extremely familiar with alternative dispute resolution, mediation, and negotiation strategies, and employ these tactics whenever possible. We keep clients advised and involve them in making key strategic and tactical decisions , while evaluating, together, both the costs and benefits of going to trial. Should litigation become necessary, our experience helps us to streamline the process, considerably reducing the costs and time commitments of a trial. While trial is a last option, our willingness and readiness to go the distance is the very quality that drives successful and cost-efficient outcomes for clients.

In a published decision issued Thursday, the Michigan Court of Appeals held that income received for legal services rendered by an attorney working in the City of Detroit to a client located outside the city are "out-of-city" services for purposes of determining income taxable by the city.

Fred Herrmann authors "It Must be a Duck: Honoring the Attorney Professional Negligence Statute of Limitations"

Michigan courts have long held that a plaintiff cannot title his true cause of action as another simply to benefit from a longer statute of limitations. A medical malpractice plaintiff cannot call her claim for professional negligence (two-year statute of limitations) a breach of contract claim (six-year statute of limitations), or a general negligence claim (three-year statute of limitations). Similarly, a client cannot sue his attorney for breach of contract or fraud (six-year statute of limitations) when his claim is based on professional negligence (two-year statute of limitations).

2018 Detroit Heart Walk a great (if rainy) success - Kerr Russell colleagues contribute over $6,000

Kerr Russell's participation in the 25th anniversary Detroit Heart Walk, benefiting the Southeast Michigan American Heart Association, was a great success, with Kerr Russell colleagues raising $6,230 to contribute to the cause. This was in addition to the firm's overall sponsorship and to member Jason Bank's leadership on the Heart Walk's executive cabinet.

Dan Beyer, William Blasses obtain favorable judgment (deed in lieu of foreclosure)

Daniel Beyer and William Blasses successfully obtained judgment in favor of one of the Kerr Russell’s clients in the Macomb County Circuit Court. The plaintiff, a defaulting borrower, sought to overturn a deed in lieu of foreclosure in an effort to unwind a transaction and try to recover property it had previously transferred to the lender.

On February 7, Kerr Russell turned out in force to support Life is a Cabaret: LIVE Musical Fundraiser for Relay For Life of Canton and Plymouth, MI. Kerr Russell team makes holiday donations to Capuchin Soup Kitchen, Wigs 4 Kids, Ronald McDonald House Charities of Ann Arbor, and Children's Hospital of Michigan

One of our traditions here at Kerr Russell is to hold a holiday raffle to benefit three local charities as well as to conduct a toy drive for local children. This year's raffle (many of the beautiful and festive prizes picture here) raised a record total of $3,450 which will be divided equally among three organizations: Capuchin Soup Kitchen, Wigs 4 Kids of Michigan, Inc., and Ronald McDonald House Charities of Ann Arbor.

Kerr Russell welcomes new associate Derek Boyd. We are so happy to have him join our team. Derek's practice will focus on commercial litigation. He also will support our medical malpractice work.
