Tamm and Indyk Win Motion for Summary Disposition
June 1, 2026
James E. Tamm and Paul M. Indyk recently won a Motion for Summary Disposition on behalf of a urologist in Wayne County.
The medical malpractice lawsuit alleged that the urologist improperly placed a surgical drain during a nephrectomy procedure causing injury to the patient’s colon. A motion for summary disposition was filed which argued that plaintiff failed to produce expert testimony to directly attribute a breach of the standard of care to the urologist. Further, the plaintiff did not produce any testimony or evidence that the urologist’s treatment was a proximate cause of the alleged injury. Judge Qiana Lillard of the Wayne County Circuit Court granted the Motion for Summary Disposition and dismissed the case in its entirety as to the urologist.
